Terms of Use

These terms apply to your use of Practice Site Check (the “Checker”), a free tool from Practice Strategy & Technology (“we”, “us”), operated by Alex Marshi. By using the Checker you agree to them. If you do not agree, please do not use it.

What the Checker does

The Checker looks at your home page and several of the other public pages it links to, and reports on common privacy, accessibility and security gaps, including signs that are sometimes associated with HIPAA concerns, such as third-party tracking scripts and unsecured forms. It gives you a score and a list of results you can read on screen or download as a PDF.

Results are not legal advice or a compliance determination

The Checker is an automated, heuristic tool. It reviews only a sample of your public pages, it can miss issues, and it can flag things that are not problems. Its results are not legal advice, a HIPAA risk analysis, a security audit, an accessibility certification, or a determination that your website or practice is or is not compliant with any law. A high score does not mean you are compliant, and a low score does not mean you are not.

You are responsible for your own compliance. For legal questions, please consult a qualified attorney or compliance professional.

Using the Checker

Please use the Checker only for websites you own, run, or are authorized to review. You agree not to:

  • run scans in bulk or with automated scripts, or work around the limits on how often you can scan;
  • use the Checker to probe, overload or attack any website or server;
  • enter information that is not yours to share, or any client or patient information;
  • use the Checker or its reports in a way that is unlawful, misleading or harmful.

We may limit or block access if we think the Checker is being misused.

Your information

To run a scan we ask for your work email and website address, and a box you tick to agree that we may store them and contact you about your results. You can opt out at any time. How we handle your information is explained in our Privacy Policy.

Your report

The report is yours to use for your own practice and to share with your team and advisors. Please do not present it as a certification, seal or endorsement by us, or alter it and present it as ours.

Consultations

Offers of a free consultation are optional. Booking one does not obligate you to anything. Any paid work would be agreed separately in writing. Using the Checker does not create a professional, clinical or attorney-client relationship between you and us, and nothing here is mental health, medical or legal advice.

Other websites

The Checker reads websites we do not own or control. We are not responsible for their content. Links to outside services, such as our booking calendar, are governed by those services’ own terms and privacy policies.

Ownership

We own the Checker, its design and its report format. You keep all rights in your own website and its content.

No warranty

The Checker is free and is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises that it will be accurate, complete, uninterrupted or error-free, and we disclaim all warranties, express or implied.

Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising from your use of the Checker or reliance on its results. Our total liability for any claim relating to the Checker is limited to $100. Some places do not allow these limits, so they may not apply to you in full.

Changes

We may change the Checker or these terms. If we change the terms we will update the date at the top, and your continued use after that means you accept the updated terms. We may also pause or end the Checker at any time.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in California, and you agree to their jurisdiction.
